1. Identification of the seller

2. Purpose, scope and acceptance
These Terms and Conditions govern the distance purchase of the assortments and products offered by IBERIUM SELECTION. They are supplemented by the Legal Notice, Privacy Policy, Cookie Policy and the specific information displayed on each product page.
The purchaser must read and accept these Terms and Conditions before placing an order. Electronic acceptance shall have the same legal effect as a handwritten signature and shall allow these Terms and Conditions to form part of the contract.
The provisions identified as consumer rights shall apply exclusively to natural persons acting for purposes outside their trade, business, craft or profession, and to legal persons or entities that may qualify as consumers under applicable law. Where the purchaser is a company or professional, these Terms and Conditions shall apply except in respect of provisions legally reserved for consumers and without prejudice to any specific conditions agreed in writing.
3. Capacity to contract and alcoholic beverages
Purchases may only be made by persons with sufficient legal capacity. Assortments containing wine, beer or any other alcoholic beverage are restricted to persons over 18 years of age.
Before purchasing an assortment containing alcohol, the purchaser must declare that they are of legal age. Delivery may be subject to verification of the recipient’s age by means of a valid identification document and to the recipient also being over 18 years of age. If legal age cannot be verified, the alcoholic product shall not be delivered and the applicable failed-delivery rules shall apply, in all cases in accordance with applicable legislation.
4. Products and food information
IBERIUM SELECTION markets assortments for two people consisting of food and beverages manufactured and packaged by their respective manufacturers or suppliers. IBERIUM SELECTION does not open, cut, cook or repackage food products.
Each assortment page shall specify its contents, customisation options, quantity, price, ingredients, allergens, storage conditions, instructions for use and any other food information legally required before purchase. The manufacturer’s labelling and the documentation available on the product page shall supplement such information.
Photographs are for illustrative purposes only. External presentation may vary without affecting the essential characteristics, quantity, quality or safety of the product.
Allergies and intolerances
The purchaser must review the information relating to each product before placing an order. A prior enquiry may be made through the customer service channels, but IBERIUM SELECTION does not provide medical advice and cannot guarantee the absence of traces or cross-contamination beyond the information provided by manufacturers and suppliers.
No substitution shall be made where it would introduce new allergens compared with the product initially selected. If handling an enquiry requires the processing of health-related data, the relevant explicit consent shall be requested.
Substitutions
If a product is unavailable, IBERIUM SELECTION shall not replace it unilaterally where the change affects the choice, composition, allergens or relevant characteristics of the order. The purchaser shall be informed and offered the option to accept an equivalent product of equal or higher quality at no additional cost, amend the order or receive the corresponding refund. A substitution shall only be made after the purchaser’s express acceptance.
5. Purchasing process
Purchases may be made with or without a customer account. The purchasing process shall be available in the languages indicated on the Website. The Spanish-language version shall be the contractual reference version, without prejudice to any mandatory rights that may apply.
· The purchaser selects the assortment, permitted options, quantity and available date or time slot.
· The purchaser enters billing and delivery details and reviews the summary, total price and restrictions.
· The purchaser corrects any errors before payment and expressly accepts these Terms and Conditions.
· The purchaser activates a button clearly indicating that the order entails an obligation to pay.
· Payment is made through the enabled payment gateway.
· The purchaser receives the order confirmation and summary by email.
The contract shall be deemed concluded when payment has been authorised and the system sends the order confirmation, without prejudice to subsequent cancellation and refund in the event of a manifest error, lack of availability or justified impossibility of delivery.
IBERIUM SELECTION shall retain the contractual documentation and the accepted version for the legally required periods. The customer may save these Terms and Conditions and shall retain the confirmation sent to their email address.
6. Availability and order limits
The minimum order is one assortment. No general maximum quantity is established, although large-volume orders are subject to availability and may require specific lead times or conditions. If IBERIUM SELECTION is unable to meet the stated timeframe, it shall inform the purchaser before dispatch and allow them to accept the revised timeframe or cancel the order at no cost.
Automatic receipt of an order does not oblige IBERIUM SELECTION to supply products affected by a manifest error in price, description or availability. In such cases, the purchaser shall be informed without delay and any amount charged shall be refunded in full, unless the purchaser accepts a valid alternative.
7. Prices, taxes and charges
Prices displayed to consumers include applicable taxes. Delivery charges shall be shown separately before payment unless an offer clearly states that they are included. The purchaser shall be informed of and accept the total price and any additional charges before placing the order.
The standard delivery area is mainland Spain. Orders may also be accepted for Portugal and Andorra, with the logistical costs displayed and accepted before payment being charged. Deliveries to Andorra, islands or other territories shall only be arranged following prior consultation and after informing the customer of the applicable logistical, customs and tax costs or, where these cannot reasonably be calculated in advance, of the possible existence of additional charges. The order shall only be confirmed after the customer has expressly accepted the financial terms communicated.
Companies, hotels, property managers or distributors may have negotiated rates, discount codes or specific terms. Such financial conditions shall only apply where they have been expressly accepted and shall not modify previous orders.
8. Payment and invoicing
Credit cards, debit cards and Bizum are accepted through Redsys and CaixaBank. The amount shall be charged when the order is confirmed. Full payment details are processed by the payment gateway and are not stored in IBERIUM SELECTION’s ordinary systems.
If payment is declined or cannot be authenticated, the order shall not be confirmed. IBERIUM SELECTION may apply reasonable fraud-prevention measures and request proportionate additional information, without using such information for incompatible purposes.
The invoice shall be issued using the details provided by the purchaser, who must verify them before completing the order. Issuance of an electronic invoice shall require the consumer’s express consent, which may be withdrawn. Consumers shall be entitled to receive a paper invoice free of charge upon request. Corrections may be requested through the customer service channels.
9. Delivery area, timeframe and schedule
Deliveries shall be made by SEUR Frío in mainland Spain and, where the order has been accepted subject to the applicable logistical costs, in Portugal and Andorra. Islands and other territories require prior consultation. The usual estimated delivery timeframe is the next working day after processing, and any commercial reference to “24 hours” does not guarantee delivery on non-working days or outside the available delivery areas and schedules.
Deliveries are made Monday to Friday, from 9:00 to 20:00. Orders received by 14:00 shall be processed on the same day; orders received after that time shall be deemed received on the next working day.
The 14:00 cut-off time shall also apply on Fridays. Orders received after that time shall be processed on the next working day. Priority delivery before 13:30 shall only be advertised where available for the destination and where it has been expressly included or purchased.
The selected date or time slot constitutes a preference or estimate unless it is expressly identified as a guaranteed commitment. Public holidays, destination restrictions, weather incidents, peak demand or circumstances beyond reasonable control may affect the delivery timeframe.
10. Delivery to hotels and apartments
Delivery may be made to tourist apartments where there is a reception desk or where the recipient can receive the order during the indicated time slot. In hotels, the order may be delivered to reception using the recipient’s name and, where appropriate, room number.
With the purchaser’s authorisation, the order may be received by reception, the host, the accommodation manager or another designated person. Delivery to such a person shall constitute delivery to the recipient. The purchaser is responsible for providing accurate details, checking that the accommodation accepts deliveries and obtaining any consent necessary to communicate the recipient’s data.
Delivery may be evidenced by the date, time, signature, recipient’s name and any other information lawfully provided by the carrier. No more identifying information shall be collected than is necessary to evidence delivery or comply with legal obligations.
11. Recipient absence and second delivery attempt
If the first delivery cannot be completed due to absence, lack of access, unjustified refusal or incorrect information attributable to the purchaser or recipient, a second delivery attempt shall be made on the next working day at no additional cost.
If the second attempt also fails for a reason attributable to the purchaser or recipient, the order may be deemed cancelled and returned to IBERIUM SELECTION. Only the direct transport costs actually incurred for outward and return carriage may be deducted from the amount to be refunded, without duplicating any shipping amounts already charged and subject to a total maximum of EUR 27.83, VAT included. This consequence and its maximum amount must be displayed before the contract is concluded. No deduction shall be made where the failed delivery is attributable to IBERIUM SELECTION or the carrier.
12. Cold chain, risk and receipt
All assortments include at least one refrigerated product. They are stored in refrigerated facilities and transported using insulated and refrigerated services. The retail box itself does not include thermal insulation or cold packs.
The risk of loss or damage passes to the consumer when the consumer, or a third party designated by them other than the carrier, takes physical possession of the order.
The recipient must immediately store refrigerated products at the temperature indicated on their labelling and comply with the stated expiry dates and consumption instructions.
Any loss of quality caused exclusively by failure to store the product correctly after delivery shall not be attributable to IBERIUM SELECTION. This provision does not limit consumer rights where the product had already been delivered in unsuitable condition.
13. Amendment and cancellation before dispatch
The purchaser may request a free amendment or cancellation before preparation begins and, in any event, before 14:00 on the working day on which the order is due to be processed. The request must be sent to pedidos@iberiumselection.com and must state the order number.
Once preparation or dispatch has begun, voluntary cancellation may no longer be possible due to the perishable nature of the products, without prejudice to the right of withdrawal where legally applicable and to rights relating to lack of conformity.
14. Delays and impossibility of delivery
If dispatch is delayed for reasons attributable to IBERIUM SELECTION or the logistics operator and the order cannot be delivered on the agreed date, the purchaser shall be informed without delay. Unless another timeframe has been agreed, delivery shall take place no later than 30 calendar days from conclusion of the contract. The consumer may grant a reasonable additional period or terminate the contract directly where the delivery timeframe is essential, the seller has refused delivery or any other legally recognised circumstance applies. In the event of termination, all amounts paid shall be refunded in full.
Refunds shall be made using the same payment method unless expressly agreed otherwise, without undue delay. Discount codes or commercial compensation may be offered additionally, but shall not replace any legally required refund without the consumer’s consent.
15. Right of withdrawal
15.1. General rule
Where the right of withdrawal applies, the consumer has 14 calendar days from receipt to communicate their decision without having to provide any reason. The consumer may use the form included in the Annex or submit any unequivocal statement to pedidos@iberiumselection.com.
15.2. Exceptions
The right of withdrawal does not apply, among other legally established cases, to goods liable to deteriorate or expire rapidly; sealed goods which are not suitable for return due to health protection or hygiene reasons and which have been unsealed after delivery; or goods made to the consumer’s specifications or clearly personalised.
Each product page must identify the applicable exception. Opening the external box does not in itself remove the right of withdrawal in respect of separable products that are not legally exempt. In mixed assortments, the exception shall apply to perishable goods or goods affected by health or hygiene considerations; the remaining products shall be governed by the applicable rules depending on whether they are separable and returnable.
15.3. Effects and returns
For goods not subject to an exception, the consumer must return them without undue delay and no later than 14 days after communicating the decision to withdraw. The consumer shall bear only the direct cost of return where they were informed of this in advance. IBERIUM SELECTION shall issue the refund without undue delay and, in any event, within 14 calendar days from the date on which the consumer communicates the decision to withdraw. IBERIUM SELECTION may withhold the refund until it has received the goods or until the consumer provides evidence of having returned them, whichever occurs first.
The consumer shall only be liable for any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.
16. Lack of conformity and incidents
IBERIUM SELECTION shall be liable for any lack of conformity existing at the time of delivery in accordance with consumer legislation, taking into account the perishable nature, shelf life and storage conditions of the food products.
The purchaser must report as soon as possible if the order arrives incomplete, damaged, altered, spoiled or at an unsuitable temperature. They may write to pedidos@iberiumselection.com or call +34 683 282 370, Monday to Friday, from 10:00 to 14:00.
Photographs of the product, packaging, label or any available indicator may be requested, as may temporary retention of the product where it is safe to do so. These requests are intended to verify the incident, but may not be used to deprive the consumer of their rights where other sufficient evidence exists.
Depending on the nature of the problem and the legally appropriate remedy, a replacement, reshipment, price reduction or refund shall be offered. The remedy shall be free of charge to the consumer. Discount codes shall only be offered as an additional convenience or where freely accepted by the customer.
Any product showing signs of spoilage, tampering with the seal, unsuitable temperature or any other health risk must not be consumed.
17. Returns
Before sending products back, customers are advised to contact IBERIUM SELECTION for instructions and to determine whether the return should be sent to C/ Lehendakari Aguirre, 39, 28914 Leganés (Madrid), Spain, or to another operational address. This prior contact does not affect the valid exercise of the consumer’s statutory rights.
For food safety reasons, voluntary returns of perishable, refrigerated or unsealed products shall not be accepted where a legal exception to the right of withdrawal applies. This restriction does not affect defective, incorrect or non-conforming products.
18. Coupons, promotions, gift cards and subscriptions
Coupons and promotions shall be subject to the terms displayed for each campaign, including validity period, applicable products, territory, usage limits and compatibility. They may not be applied retroactively or redeemed for cash unless required by law.
Gift cards, vouchers or subscriptions shall not be offered until their specific terms have been defined and published, including value, expiry, partial use, loss, duration, renewal, recurring price and cancellation.
19. Customer account and data protection
The customer is responsible for maintaining the confidentiality of their credentials and for reporting unauthorised access. The customer may request deletion of the account, without prejudice to the blocked retention of data necessary to comply with legal obligations or address potential liabilities.
The processing of purchaser, recipient and receiving-person data is governed by the Privacy Policy. Data shall be disclosed to the payment gateway, financial institution, carrier and accommodation provider only to the extent necessary to fulfil the order or comply with legal obligations.
20. Liability and force majeure
IBERIUM SELECTION shall be liable for any breach attributable to it in accordance with the terms established by law. It shall not be liable for delays or failures caused by unforeseeable or unavoidable events beyond its reasonable control, but shall inform the purchaser and take measures to mitigate their effects.
Nothing in these Terms and Conditions excludes or limits mandatory consumer rights or any liability that cannot lawfully be excluded.
21. Customer service, complaints and dispute resolution
Complaints may be submitted to pedidos@iberiumselection.com, by telephone on +34 683 282 370 or in writing to the seller’s registered address. Receipt shall be acknowledged and a response shall be provided as soon as possible and, in any event, within a maximum of 15 days from submission.
PREMIUM BOX ONLINE, S.L.U. has not voluntarily joined the Spanish Consumer Arbitration System and has not undertaken to use any specific alternative dispute resolution body. If a complaint cannot be resolved directly, the consumer shall be provided with information about the competent body where legally required.
No link is provided to the former European Online Dispute Resolution platform, as that platform has been discontinued.
22. Governing law and jurisdiction
The contract shall be governed by Spanish law, without prejudice to any mandatory rules of the consumer’s country of residence that may apply. Disputes shall be submitted to the courts and tribunals having jurisdiction in accordance with the law. Where the purchaser is a consumer, the jurisdiction legally applicable to that consumer shall be respected.
23. Validity and amendments
The applicable version shall be the version accepted when the order is placed. Subsequent amendments shall not affect contracts already concluded unless validly agreed or required by law. The update date shall be stated at the beginning of the document.
